The powers granted under a Power of Attorney can be broad or specific, and you can control when a Power of Attorney triggers and when it expires. Every adult should have a Power of Attorney.
Healthcare Power of Attorney
A Healthcare Power of Attorney is a form that allows a loved one to address healthcare decisions and to complete related tasks for us during our incapacity. This form is often used together with the Living Will form.
Healthcare Power of Attorney for Minor Children
This form allows a loved one to address healthcare decisions and to complete related tasks for your minor child during our absence. For example, if you are a parent and travel out of state on vacation, you might leave your child with a family member, who would need a Healthcare Power of Attorney for Minor Children to help care for your child.
Living Will
A Living Will is a form that enables you to express your wishes not to be administered life-sustaining procedures, when death is imminent, and the provision of those procedures will merely prolong the natural dying process. You can decide whether your Living Will is controlling or whether you prefer to have your Healthcare Representative make these end-of-life decisions for you.
Additional Information
While “end of life” planning documents, such as a Last Will & Testament or a Living Trust, are important planning documents, Powers of Attorney are just as important. Statistically, there is a good chance each of us will be incapacitated for some period of time and will need help managing our affairs. A Power of Attorney is often the best tool to plan for those possible periods of our incapacity.
